Thursday on The Robert Scott Bell Show:
Sacred Fire of Liberty!
It’s that time of the week where we get to explore the political healing that this country needs so desperately! Jonathan Emord is back to help us dissect the latest political news that’s fit to print:
Watch: Joe Biden Forgets Who He’s Talking To — Calls Australian PM ‘That Fella Down Under’ U.S. President Joe Biden appeared to forget who he was talking to Wednesday night when he looked away from his prepared notes for just a few seconds and addressed Australia’s Prime Minister Scott Morrison as “that fella down under.” The verbal fumble came during an exchange between the two leaders and UK Prime Minister Boris Johnson detailing a defence deal struck by the long standing allies to help Australia acquire nuclear-powered submarines. “Thank you Boris (Johnson) and I want to thank uh… that fella Down Under,” Biden said as he turned to the large screen Morrison was on. “Thank you very much pal… appreciate it prime minister.” The Australian leader simply smiled back politely and gave a thumbs up. Social media users cringed at the exchange before describing Biden as “hopeless,” “embarrassing” and not up to the demands of the job. The Twitter hashtag #THATFELLOWDOWNUNDER was quick to follow as various news outlets first digested the consequences:
Tucker Carlson: Mark Milley is a danger to the country, and Congress doesn’t seem to care Yesterday we learned that Mark Milley, chairman of the Joint Chiefs of Staff, is a danger to the country. That was not totally surprising. We already knew he was a reckless nutcase. In June, in the middle of a televised congressional hearing, Milley leveled a racial attack against more than half of this country. Milley told Congress that something called White rage was a national crisis. He never proved it or even defined the term and yet still he kept his job, which says as much about Congress as it does about him. Then in July, we learned that Milley had suggested the U.S. military was willing to use violence against Donald Trump, who was then the sitting president. “We’re the guys with guns,” he told fellow officers. Still, Congress did nothing. Now, thanks to a new book by Bob Woodward and Robert Costa, we’ve learned that Milley secretly collaborated with our greatest military rival, the government of China. On Oct. 30 last year, according to the book, Milley called his counterpart in China – a Chinese general. He did not tell his boss about the call either before he made it or after. Here was Milley’s message for the Chinese military: “We are not going to attack or conduct any kinetic operations against you. General Li, you and I have known each other for five years. If we’re going to attack, I’m going to call you ahead of time. It’s not going to be a surprise.”
CNN Poll: Most Americans feel democracy is under attack in the US Most Americans feel democracy is under attack in this country (56%), according to a new CNN Poll conducted by SSRS, as 51% say it is likely that elected officials in the US will successfully overturn the results of a future election because their party did not win. Nearly all Americans feel that democracy in the US is at least being tested: 93% total say that democracy is either under attack (56%) or being tested but not under attack (37%). A scant 6% say that American democracy is in no danger. Republicans are far more likely than Democrats to say that democracy is under attack, and that view is most prevalent among those who support former President Donald Trump. All told, 75% of Republicans say democracy is under attack, compared with 46% of Democrats. Among Republicans and Republican-leaning independents, those who say Trump ought to be the leader of the party are much likelier to see democracy as under threat: 79% in that group vs. 51% among those who say Trump should not be the party’s leader.
Biden’s Vaccine Mandate Is Unconstitutional On September 9, President Joe Biden unveiled his Covid-19 Action Plan, “a six-pronged, comprehensive national strategy” to combat the pandemic. The most controversial provision, covering some 80 million Americans, mandates that all employers with 100 or more employees must ensure that each worker is either fully vaccinated or provides weekly negative Covid test results. Republican governors were quick to condemn the mandate, with some vowing legal challenges. “@JoeBiden see you in court,” South Dakota governor Kristi Noem tweeted. Governor Henry McMaster of South Carolina wrote that he would fight Biden “to the gates of hell.” He won’t have to go that far: the courts are likely to strike down Biden’s mandate as a clear violation of the Constitution’s principles of federalism and separation of powers. Leaving aside the merits of a vaccine mandate, such decisions properly belong to the states, not the federal government. Supreme Court precedents on the validity of vaccine mandates—Jacobson v. Massachusetts (1905) and Zucht v. King (1922), both involving smallpox vaccination—involve state, not federal, laws. The Court has never suggested that Congress could adopt such a mandate, and for good reason. In our federal system, states enjoy broad “police powers” to enact laws designed to protect the health and safety of their citizens, whereas the central government has only those powers enumerated in the Constitution. The Tenth Amendment further guarantees that states retain the powers not specifically delegated to the federal government.
Democrats Reject Plan to Mandate Coronavirus Vaccines for Immigrants House Democrats rejected a plan this week that would have required immigrants to the United States to take one of three available Chinese coronavirus vaccines despite mandates on American citizens from President Joe Biden’s administration. Last week, Biden ordered that the Department of Labor’s Occupational Safety and Health Administration (OSHA) develop a rule requiring all private companies with 100 or more employees to mandate the vaccine or be subjected to weekly coronavirus tests. Biden also ordered the Centers for Medicare and Medicaid Services (CMS) to require vaccines for all health care workers who work at facilities receiving federal Medicare or Medicaid funding. As Breitbart News reported, Biden has seemingly not imposed any such vaccine requirements on border crossers, illegal aliens, legal immigrants, or Afghan refugees who are arriving in the U.S. During a hearing for the Democrats’ $3.5 trillion budget reconciliation, Rep. Darrell Issa (R-CA) proposed an amendment that would require the vaccine for foreign nationals in the U.S. who are seeking to adjust their immigration status to remain in the U.S. Every Democrat on the House Judiciary Committee opposed the vaccine mandate for immigrants while every Republican supported the measure.
California Sheriff Stands Up to Federal Government: Refuses to Implement Vaccine Mandate A sheriff in California has made it clear he will not be enforcing the federal vaccine mandate on his employees at the Riverside County Sheriff’s Office. In a September 13 press release, Sheriff Chad Bianco focused on sweeping vaccine mandates implemented by the Biden administration on September 9. The press release referenced a podcast the sheriff’s office had recently produced that calls into question the federal government’s authority to mandate a vaccine. “Over the past couple of weeks, the idea of forced vaccination has caused much concern across the entire country. There is absolutely nothing in my podcast that was incorrect or irresponsible,” the release read. “It is factual and common sense based. To repeat the context of the podcast, I will not enforce the vaccine mandate on Sheriff’s Department employees.” “In November of 2018 the residents of Riverside county elected me as their Sheriff. I stood before God and swore an oath to the Constitution of the United States, and the Constitution of the State of California,” the sheriff continued. “It is my responsibility to protect the public from the criminal element, as well as being the last line of defense from tyrannical government overreach. The government has no ability and no authority to mandate your health choices. As your Sheriff I have an obligation to guard your liberty and freedom.”
The Authoritarians: Their Assault on Individual Liberty, the Constitution, and Free Enterprise from the 19th Century to the Present
Jonathan W. Emord is one of the nation’s foremost experts on constitutional and administrative law and has practiced before the federal courts and agencies for thirty-five years. In The Authoritarians, Emord reveals the untold story and largely hidden practices of Authoritarians who have worked inside the United States government to undermine the Constitution and override rights protections since the earliest days of the Progressive Era. Emord traces the intellectual origins of Authoritarianism to its Hegelian roots in Germany. He shows how legions of academics, trained to hate the American system of government, became predominant in the major universities of America, entered government as top advisors, and successfully orchestrated an overthrow of the Constitution’s limits on power which put the rights of individuals in jeopardy from the Progressive Era through the New Deal to today. In The Authoritarians, readers learn how Authoritarians endorsed forced sterilization of 60,000 American citizens whom they deemed “undesirable” and “unfit”. Readers also learn how Authoritarians selectively created monopolies and overcame the constitutional limits on government power the Founding Fathers put in the Constitution to prevent tyranny, thus ushering in the foundation for a socialist state.
In The Authoritarians, Emord reveals the lies told by advocates of the Black Lives Matter organization, Antifa, and the 1619 Project. He presents the startling fact that the first slaves in the Jamestown Colony in 1619 were not blacks, but whites and that in the antebellum South slave owners were not only white, but black. Readers also learn the inherent failings of socialism; the tremendous cost it imposes on human lives; and the grave threat to the survival and success of liberty and justice in America posed by Authoritarians such as Alexandria Ocasio-Cortez, Bernie Sanders, Nancy Pelosi, Chuck Schumer, Ed Markey, Joe Biden, and Kamala Harris. The Authoritarians unveils a detailed strategy for restoring constitutional protection for individual rights and fending off the horrors of a socialist tidal wave now drenching America.
Local Detroit TV Asks for Stories of Unvaxxed Dying from COVID – Gets over 180K Responses of Vaccine Injured and Dead Instead The corporate media narrative that unvaccinated people are filling up the hospitals and dying from COVID is quickly falling apart, perhaps faster than they even expected. WXYZ TV Channel 7 in Detroit asked their viewers on their Facebook Page last Friday to direct message them if they lost a loved one due to COVID-19 if they refused to get one of the COVID-19 vaccines. This is a clear indication that they are getting desperate to find these stories, and are having a difficult time finding them. I don’t know if they got any such stories through direct messaging, but the post on their Facebook Page, as of the time of publication today, had received over 182,000 comments, and they seem to be all comments of those who have lost loved ones after receiving a COVID shot, and comments asking them why they are not covering that story. I paged through many dozens of the comments, and did not see a single one stating that they lost someone to COVID after refusing a COVID-19 shot. People who have been silenced and censored on Facebook and other Big Tech platforms took advantage of the opportunity to share their stories instead. It is amazing that Facebook left these up, but after so many had commented, it would probably have been an even bigger story if they had taken down the post and comments. I wonder what WXYZ will do now? Will they do what most corporate media companies do, fueled by almost unlimited resources from their billionaire Wall Street owners who are almost all connected to the pharmaceutical industry, and just go out and hire actors instead to do the story and make them up?
Moderna says COVID-19 vaccine protection wanes, makes case for booster New data from Moderna Inc’s (MRNA.O) large COVID-19 vaccine trial shows that the protection it offers wanes over time, supporting the case for booster doses, the company said in a news release on Wednesday. “This is only one estimate, but we do believe this means as you look toward the fall and winter, at minimum we expect the estimated impact of waning immunity would be 600,000 additional cases of COVID-19,” Moderna President Stephen Hoge said on a conference call with investors. Hoge did not project how many of the cases would be severe, but said some would require hospitalization. The data stands in stark contrast with data from several recent studies that suggested Moderna’s vaccine protection lasts longer than a similar shot from Pfizer Inc (PFE.N) and German partner BioNTech SE . Experts said the difference is likely due to Moderna’s higher dose of messenger RNA (mRNA) and the slightly longer interval between the first and second shots. Both vaccines proved to be exceedingly effective at preventing illness in their large Phase III studies. Wednesday’s analysis, however, showed higher rates of infection among people vaccinated roughly 13 months ago compared with those vaccinated roughly eight months ago. The study period was from July-August, when Delta was the predominant strain. It has yet to undergo peer review.
A Pfizer Analysis Makes The Case For A COVID Vaccine Booster The Food and Drug Administration released an analysis by Pfizer on the need for a booster shot of the Pfizer-BioNTech COVID-19 vaccine. Pfizer’s analysis says data from Israel and the United States in the context of the delta variant suggests “that vaccine protection against COVID-19 infection wanes approximately 6 to 8 months following the second dose.” The company said the available data supports its request for FDA approval of a third dose of the COVID-19 vaccine to be given about six months after the second dose in people 16 years and older. The agency posted the briefing document and data ahead of a public advisory committee meeting scheduled for Friday. The committee is the same one that voted in support of emergency authorization of the Pfizer-BioNTech vaccine in December. In an unusual wrinkle, the FDA’s analysis, which would shed light on the agency’s stance, wasn’t released simultaneously. Typically the agency posts its own briefing document at the same time as a company’s. Late Wednesday morning, the agency put its analysis online without taking a clear stand on whether it supports a booster. The FDA noted that some observational studies suggest that the efficacy of Pfizer-BioNTech’s vaccine wanes with time and may be challenged by the delta variant. However, the agency noted that current data indicates that the Pfizer-BioNTech, Moderna and Johnson & Johnson vaccines “still afford protection against severe COVID-19 disease and death in the United States.”
Gov. Hochul announces universal mask requirement for child care and daycare centers New York Governor Kathy Hochul announced a universal mask requirement for child care and daycare centers in the state effective today in response to the Delta variant and recent surge in COVID-19 cases across the state. The requirement applies to New York State Office of Children and Family Services-licensed and -registered child care centers, home-based group family and family child care programs, after-school child care programs and enrolled legally exempt group programs during operational hours. – NYS Governor’s Office According to the governor’s office the requirement brings the state into compliance with CDC guidance issued in July and brings child care facilities into alignment with school masking requirements announced by Hochul on her first day in office. Owner and Director of Jumped Up Jellybeans daycare, Danielle Kinsman, said young kids wearing masks is a safety concern. “It’s pretty impossible to keep a mask on a two-year-old for an entire day. It doesn’t even seem realistic,” Kinsman said. “You cannot show expressions with a mask on. You can’t show them how to form words. As an owner, I also look at it from a liability. I can’t see if they’re choking. That’s a big issue for me.”
Gov. Hochul: Religious Exemption Not A Legitimate Excuse To Avoid COVID Vaccine Governor Kathy Hochul says she does not believe health care workers in New York should be able to cite a religious exemption to avoid getting the COVID-19 vaccine. The governor was reacting to a court decision temporarily upholding the rights of some health care workers to refuse the vaccine on religious grounds. A federal judge in Utica Tuesday issued what’s known as a temporary restraining order against the portion of the state’s vaccine mandate that does not allow for religious exemptions. Hochul says her health department deliberately excluded religious exemptions from the mandate, which requires all health care workers to be vaccinated by September 27. She says while the state’s attorneys will be arguing the case in court on September 28, her personal opinion is that a religious exemption is not a legitimate excuse. “I’m not aware of a sanctioned religious exemption from any organized religion, in fact they are encouraging the opposite,” Hochul said. “Everybody from the Pope on down is encouraging people to get vaccinated.” Hochul says New Yorkers have the right to receive health care without worrying that the person attending them might be unvaccinated and more likely to spread the virus. The governor, saying that she is concerned about the spread of the delta variant of the virus, also imposed new mask mandates for day care and child care centers. Everyone aged 2 years old and up will have to wear them, effective immediately, regardless of their vaccination status
Over 50 Kingston businesses say they won’t comply with COVID mandates A number of small and prominent businesses in the Kingston area have come together via a private Facebook group to discuss how they won’t be cooperating with government mandates pertaining to COVID-19. The group, Kingston and Surrounding Area Businesses Supporting Freedom of Choice, encompasses over 50 businesses, over 750 total members, and sees a median average of 25 posts per day, despite being less than a week old. According to Facebook, the group was created by “Gillian Friedman.” Group members have declared on the page that non-vaccinated and non-mask-wearing patrons are more than welcome in their establishments, and are also actively encouraging other businesses – as well as the general public – to resist government COVID-19 mandates. Some owners running businesses which require entering a personal abode for work – such as carpenters and landscapers – have also declared on the page that non-vaccinated and ‘maskless’ homeowners may still hire them for projects, and that the workers and owners themselves will remain unvaccinated and maskless while working – if these workers choose to do so. One prominent Kingston restauranteur (and member of said Facebook group) went so far as publicly declaring his stance through his business signage with the message “SAY NO TO VAX PASSPORTS. ALL WELCOME AT JAKKS.” Kelly Hale, owner and operator of J.A.K.K. Tuesdays Sports Pub on Progress Avenue in Kingston’s west end, was heralded as a “crusader for good” by members of the page for his bold public statement – and he takes the moniker quite seriously.
To the Governor: California Bill Would Allow CBD in Food Despite FDA Prohibition Last week, the California Assembly gave final approval to a bill that would authorize the legal sale of food and food additives containing CBD within the state, despite ongoing FDA prohibition on the same. Asm. Cecilia Aguiar-Curry (D-Winters) filed Assembly Bill 45 (AB45) last December. The legislation would allow cannabinoids and other hemp extracts to be added to dietary supplements, food, beverages, cosmetics and pet food, despite FDA prohibition on the same. The bill declares that a dietary supplement, food, beverage, cosmetic, or pet food is not adulterated by the inclusion of industrial hemp or cannabinoids, extracts, or derivatives from industrial hemp as long as it meets state specifications. The enactment of this legislation would end state prohibition on the sale of CBD and CBD products based on federal law. This is crucial because despite removing the plant from the list of controlled substances, the federal government still prohibits the sale of CBD products in food under FDA rules. On Sept. 8, the Senate passed the final version of AB45 by a 29-2 vote. The next day, the Assembly approved the final version by a 64-3 vote. It now goes to Gov. Gavin Newsom’s desk for his consideration. Not everybody supports the proposed law. A collision of hemp farmers opposes the bill because it prohibits the in-state sale of smokeable hemp until the legislature creates a tax structure for those products. Aguiar-Curry said she plans to run a tax bill next year. Nevertheless, according to MJBiz Daily, California Hemp Farmers Guild President Josh Schneider said the legislature “sacrificed” small hemp farmers in favor of large CBD manufacturing companies and that there’s already a “chill on the market.”
