The Constitution’s 13 Defenses Against Socialism and Communism The Constitution contains numerous defenses against authoritarianism. If given its plain and intended meaning, the Constitution prevents socialists and communists from holdingelective office on the federal and state levels, guarantees a republican form of government, and protects people from having their lives, liberties, and property taken away without due process of law. Since before the Constitution’s inception in 1787, the Founding Fathers feared it would be corrupted and potentially defeated unless a virtuous and vigilant public exercised the franchise to ensure full protection for their own unalienable rights. Sadly, as recent American history bears witness, circumstances have repeatedly arisen in which the Republican form has been twisted, bent, and broken by those in government in pursuit of their own self-interest at the expense of the public, from the Progressive Era to the present. Madison anticipated the harms to constitutional order that would arise from corrupt politicians. He did so in a letter to Jefferson dated October 17, 1788, writing of his fear that the Bill of Rights would be but a “parchment barrier” against officeholders whose desire forpower and control would overcome their respect for the Constitution’s limits. But if the Constitution’s limits were honored in our time, they would indeed stand as a bulwark against the new Marxist authoritarians, like AOC, who seek to supplant our republic with socialism or communism. The Constitution contains at least 13defenses against that happenstance.
Supreme Court Rules Constitutional Challenges to Agencies May First Be Brought in Federal Court The United States Supreme Court published a momentous decision on Friday, April 14: Axon Enterprises v. Federal Trade Commission. After decades of lower court deference to federal agency proceedings, the high Court allowed two parties (one suing the FTC and another the SEC) to bring their constitutional challenges against those agencies’ administrative proceedings in federal court in the first instance. Before the decision, it was almost a truism that any legal attack, even a constitutional attack, on agency proceedings could not be heard in federal court until after a final order from the agency issued, the so-called exhaustion doctrine. With the proverbial stroke of a pen, in a decision authored by Justice Elena Kagan and joined by Roberts, Thomas, Alito, Sotomayor, Kavanaugh, Barrett, and Jackson (with a concurrence by Gorsuch), the Supreme Court fundamentally altered the landscape of administrative law, redirecting it to the Constitution’s limits on power. In both of the cases, the plaintiffs sued the agencies (FTC and SEC) in federal court at the outset of agency proceedings, variously arguing (1) that those proceedings were so biased against the accused as to violate the Due Process Clause of the Fifth Amendment and (2) that the agency rules for removal of Administrative Law Judges violated the Appointments Clause of the Constitution, Article II, Section 2. They also argued (3) that the combination of legislative, executive, and judicial powers in the single agencies violated the Separation of Powers, Article I, Section 1, and the Due Process Clause of the Fifth Amendment.
Berenson v. Biden: The Potential and Significance What if President Trump’s advisors worked with oil executives and tech platforms to censor green activists? What if there was concrete evidence that the Bush Administration and Halliburton board members encouraged media companies to silence journalists for challenging the official narrative of the Iraq War? What if the efforts had been successful? Surely, the media would cover the federal-corporate censorship operation with taglines of fascism. Democracy dies in darkness would echo from the halls of the Washington Post. Woodward and Bernstein would make the rounds on the Sunday morning shows, and the New York Times would dedicate its Sunday edition to the new rise in fascism. The resulting lawsuit would be heralded as a David v. Goliath in which one journalist and the First Amendment took on the most powerful forces in the nation. Berenson v. Biden should fit this narrative. Journalist Alex Berenson is suing President Biden, White House advisors, Pfizer CEO Albert Bourla, and Pfizer Board Member Scott Gottlieb for orchestrating a public-private censorship campaign against him. Last year, Berenson sued Twitter after the company banned his account. After surviving Twitter’s motion to dismiss, Berenson reached a settlement with the social media company, and his account was reinstated. Further, he gained access to concrete evidence that government actors – including White House Covid Advisor Andy Slavitt – worked to censor him for criticizing Biden’s Covid policies.
Dem Assemblyman Santabarbara: China’s Farmland Grab Has Flown Under the Radar and We Need to Ban It On Wednesday’s broadcast of the Fox Business Network’s “Cavuto: Coast to Coast,” New York Assemblyman Angelo Santabarbara (D) called for a ban on purchases of farmland by entities owned by China, Cuba, Iran, North Korea, Russia, and Venezuela and stated that China’s farmland purchases have flown under the radar. Santabarbara said, “This has been sort of flying under the radar. … Of course, this stems from just the tensions on the global stage, with China being more and more aggressive with each news cycle here.” He added, “We do not want countries that are on the foreign adversary list — there is a list that is determined by the secretary of commerce that these are countries that have engaged in conduct that threatens our national security. What more do you need than that…to put this in place when you see things like spy balloons flying overhead, surveying our land here in the United States, when we see, just here in New York City…unauthorized police outposts right in New York City? … This is behavior that threatens our national security. But, of course, we’re not just talking about China here, there [are] other countries on that list like North Korea, Russia, and other countries that [have] already been deemed to be a threat to national security. We need to protect our food supply.”
NGO that Exposed NYC Chinese Police Station Says More Operating in Texas, L.A., Nebraska Safeguard Defenders, the non-governmental organization that exposed over 100 illegal Chinese government police stations abroad last year, listed on Tuesday multiple American cities in addition to New York in which such stations are believed to still be operating. New York prosecutors announced the arrests on Monday of two individuals, “Harry” Lu Jianwang and Chen Jinping, for allegedly establishing an illicit police station in Manhattan used to harass, persecute, and threaten into repatriation anti-communist dissidents in the United States. U.S. Attorney for the Eastern District of New York Breon Peace accused China’s Ministry of Public Security (MPS) of “repeatedly and flagrantly violat[ing] our nation’s sovereignty by opening and operating a police station in the middle of New York City.” The Department of Justice (DOJ) also announced charges levied against about 40 individuals, most believed to be in China and Indonesia, for organizing “troll farms” online to spread Chinese propaganda and threaten anti-Chinese government dissidents. Some of those charged also stand accused of infiltrating an unnamed American telecommunications company to sabotage virtual events organized by dissidents, such as a memorial for the victims of the Tiananmen Square massacre. The arrests followed the publication of a bombshell Safeguard Defenders report in September titled “110 Overseas” that revealed that the Chinese government was using “service stations” around the world to spy on, threaten into silence, or attempt to repatriate political dissidents. The report exposed alleged “service stations” in New York as well as in London, Tokyo, Budapest, Sao Paulo, and cities in Africa.
Leftists Excoriate Actress Cheryl Hines for Supporting Husband Robert F. Kennedy Jr.’s Presidential Challenge to Joe Biden Leftists have pounced on Curb Your Enthusiasm actress Cheryl Hines after she voiced support for her husband, Robert F. Kennedy Jr., amid his decision to challenge President Biden for the Democrat nomination. As Breitbart News reported, Robert F. Kennedy Jr. officially announced his decision to run for president on Wednesday by running on a populist, anti-establishment platform. “I’ve come here today to announce my candidacy for Democratic nomination for President of the United States,” Kennedy said at his campaign launch in Boston. “My mission over the next 18 months of this campaign, and throughout my presidency, will be to end the corrupt merger of state and corporate power that is threatening now to impose a new kind of corporate feudalism on our country.” Though Cheryl Hines has been critical of her husband’s anti-vaccine advocacy in the past, she did issue a short statement in support of her husband’s presidential run. “My husband, Robert Kennedy Jr. announced today he will be running for President and I support his decision,” the 57-year-old actress told People. “He is a fearless leader who understands the needs of the American people and has devoted his life fighting for democracy,” she added. Hines also introduced RFK Jr. at his campaign rally on Wednesday. Last year, Cheryl Hines publicly denounced her husband when he referenced Holocaust victim Anne Frank while speaking out against the Biden administration’s vaccine mandate. “Even in Hitler’s Germany, you could cross the Alps into Switzerland. You could hide in an attic like Anne Frank did,” he said. Hines later said after a public backlash, “My husband’s reference to Anne Frank at a mandate rally in D.C. was reprehensible and insensitive. The atrocities that millions endured during the Holocaust should never be compared to anyone or anything. His opinions are not a reflection of my own.”

A myth no more: Cranberry products can prevent urinary tract infections for women Drinking cranberry juice has long been a mythical prevention strategy for women who develop a urinary tract infection—and new medical evidence shows consuming cranberry products is an effective way to prevent a UTI before it gets started. A global study looking at the benefits of cranberry products published in Cochrane Reviews has determined cranberry juice, and its supplements, reduce the risk of repeat symptomatic UTIs in women by more than a quarter, in children by more than half, and in people susceptible to UTI following medical interventions by about 53%. Cranberry juice and healthcare supplements that commonly include the fruit, such as capsules and tablets, have long been promoted as a readily available solution to ward off the infection but the most recent review in 2012, with evidence from 24 trials, showed no benefit from the products. The medical scientists behind this updated review from Flinders University and The Children’s Hospital at Westmead aimed to update these findings, as an important step in determining the effectiveness of cranberry products by looking at 50 more recent trials that included almost 9000 participants. “This incredible result didn’t really surprise us, as we’re taught that when there’s more and better evidence, the truth will ultimately come out. UTIs are horrible and very common; about a third of women will experience one, as will many elderly people and also people with bladder issues from spinal cord injury or other conditions,” says the study lead author Dr. Gabrielle Williams. “Even back in 1973, my mum was told to try cranberry juice to prevent her horrible and frequent UTIs, and for her it’s been a saviour. Despite me niggling in her ear about evidence, she’s continued to take it daily, first as the nasty sour juice and in recent years, the easy to swallow capsules. As soon as she stops, wham the symptoms are back. As usual, it turns out that mum was right! Cranberry products can help some women prevent UTIs.”
