It’s that time of the week where we get to explore the political healing that this country needs so desperately! Jonathan Emord is back to help us dissect the latest political news that’s fit to print:
The FBI raid at Mar-a-Lago was an abuse of prosecutorial discretion and a violation of the Fourth Amendment. It reveals political bias. Under the Fourth Amendment, a search warrant may only be issued from a court upon the establishment of “probable cause.” Under his Article II powers as Commander-in-Chief, the former president while still in office possessed the inherent power to determine whether any document would be deemed classified or not. In light of that inherent power and his executive privilege, a cause of action alleged against him based on his movement of documents, including those said to be classified, could not pass the “probable cause” test. Accordingly, no attorney for the Department of Justice should have sought, and no federal court should have issued, an ex parte (without advance notice to the opponent and an opportunity to be heard) warrant to search for documents at the Mar-a-Lago residence of the former president. Under the Fourth Amendment, “probable cause” must be established based on “oath or affirmation” as to the truth of the matters supporting an allegation of criminality. The things to be searched and seized, their location and nature, must be described with particularity. Probable cause is a “reasonable belief” that a crime has occurred or is about to occur. The establishment of probable cause depends on witness statements, affidavits, and evidence.
Trump Took the Fifth After FBI Raid, Parallel New York Criminal Investigation President Donald Trump exercised his Fifth Amendment rights on Wednesday when called in by Attorney General Letitia James to provide a deposition in a civil investigation that is probing allegations that he overvalued his real estate assets. In announcing on his Truth Social platform that he intended to plead the Fifth, Trump provided an explanation — a necessary gesture, given that he had said repeatedly in 2016 that Hillary Clinton aides who did the same did so because they were guilty. He said: If you’re innocent, why are you taking the Fifth Amendment? Now I know the answer to that question. When your family, your company, and all the people in your orbit have become the targets of an unfounded, politically motivated witch hunt supported by lawyers, prosecutors, and the fake news media, you have no choice. That explanation was particularly poignant in the wake of the bizarre raid Monday on Trump’s compound in Mar-a-Lago, Florida. In addition, Trump also had a strong reason to remain silent because of another, separate but parallel criminal investigation. Last year, the Manhattan district attorney, who conducted an investigation in cooperation with Attorney General James, indicted the Trump Organization and its chief financial officer, Allen Weisselberg, accusing them of tax fraud because they provided fringe benefits to employees that were not reported as income to the government.
Freedom Itself Is Gravely in Peril The FBI has raided Donald Trump’s home in Florida and opened a private safe, hanging around for hours looking for classified material that might be there. They were likely looking for items that Trump believed he had declassified – the president can do this with anything – but is still holding in his possession. Top officials of the National Archives, the DOJ, and the FBI believed otherwise and thus sought the search warrant. If the New York Times is correct, then, this is really about state secrets. Trump wanted them public. Others inside the deep-state machinery disagreed. The scene in Mar-a-Lago, Florida, gives rise to images from societies without law and constitutions, places where regimes are merely juntas seeking plunder and revenge. In this case, the problem is complicated by a mass administrative state apparatus that lives outside the democratic process. “Aides to President Biden,” reports the Times, “said they were stunned by the development and learned of it from Twitter.” This is likely true. But it gives rise to the more fundamental question: who is actually running government? If we didn’t before realize the extent of the multivariate crisis gathering all around us, now is the time. It’s a time for analysis and understanding. It’s also the time to make a decision concerning what we are all going to do about it.
Breitbart Business Digest: Joe Biden Declares Mission Accomplished on Inflation U.S. inflation slowed in July by more than expected, prompting the Biden White House to announce Mission Accomplished. “Before I begin today I want to say a word about the news that came out today relative to the economy. Actually, I just want to say a number: Zero. Today we received news that our economy had zero percent inflation in the month of July,” President Joe Biden said on Wednesday. The idea that we had no inflation in July will come as a surprise to most Americans, who saw prices on most things they buy go up. The zero figure Biden is referring to comes from the fact that the headline Consumer Price Index was unchanged from the prior month, largely due to a steep decline in the price of gas. Excluding energy, consumer prices rose 0.4 percent in July compared with June. That will not feel like zero inflation to most Americans. This is the Biden administration reverting to its preferred reaction to economic news: attempt to change reality by changing the description of reality. They love to quibble about the definition of recession, convinced that if they can mount a sophisticated enough argument that somehow Americans will be less unhappy about economic conditions—and presumably more willing to vote for Democrats in November. When inflation was being driven up by soaring gas prices, they told us to look at underlying inflation and not pay attention to “Putin’s price hikes.” Now that gas is pulling down headline inflation, the president takes to the national airwaves to declare inflation has fallen to nothing.
Pelosi: China Is a ‘Strong Democracy’ — ‘One of the Freest Societies in the World’ Fresh off her tour of Asia, House Speaker Nancy Pelosi (D-CA) touted China as “one of the freest societies in the world.” While speaking with NBC “Today” host Savannah Guthrie, Pelosi emphasized the importance of her bipartisan trip to Taiwan, that was met with threats from the Chinese Communist Party. The speaker also described China as a “strong democracy.” “[Y]ou know what? Why don’t we just show China that we support Taiwan? It is part of the U.S. — the Taiwan Relations Act,” Pelosi stated. “We didn’t go there to change our policy. We still support the One China Policy. We go there to acknowledge the status quo is what our policy is. There was nothing disruptive about that. It was only about saying China is one of the freest societies in the world. Don’t take it from me. That’s from Freedom House.” “It’s a strong democracy; courageous people,” she continued. “I don’t know why it is — except there’s some commercial interests who would like to diminish the relationship. But … tomorrow, we’ll have a press conference; you’ll hear from my other members about the pride we took in going there, the reception we received, the fact that the Chinese are going to do what they’re going to do. And just because … the president of China acts like a bully, has his own insecurities, it doesn’t mean that I’m going to have him do my — the schedule for members of Congress.
